Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the website, courses, and related services (the "Platform") operated by NextGen InnovateLabs Pvt. Ltd. ("NextGen", "we", "us", or "our"), a company registered in India with its registered office in Hyderabad, Telangana. By creating an account, enrolling in a course, making a payment, or otherwise using the Platform, you ("you", "the user", or where applicable "the learner") agree to be bound by these Terms. Please read them carefully. If you do not agree, do not use the Platform.

The Platform is intended for use by learners of all age groups, including both adults and minors under the age of 18. If you are below 18, you may use the Platform only with the involvement, consent, and supervision of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Platform. References to "you" include such parent or guardian where the context requires.

1. Eligibility, Accounts, and Registration

To enrol in a course you must register for an account and provide accurate, current, and complete information, including a valid email address and, where the learner is a minor, the details and consent of a parent or legal guardian. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us promptly at contact@nextgenlab.in if you suspect any unauthorised use.

You agree not to share, sell, or transfer your account or course access to any other person. Each enrolment grants access to a single named learner unless we expressly agree otherwise in writing (for example, under a school or institutional licence). We may suspend or terminate accounts that contain false information, are shared in breach of these Terms, or are used in a manner that violates these Terms or applicable law.

2. The Platform and Our Services

NextGen provides experiential, technology-focused educational programs in areas such as Artificial Intelligence, Generative AI, automation, and emerging technologies, delivered online through pre-recorded content, live or interactive sessions, projects, assessments, and supporting materials as described on the relevant course page.

Course descriptions, schedules, curricula, instructors, durations, and inclusions are provided for guidance and may be updated to improve quality or reflect operational needs. We will not make changes that materially reduce the core learning outcomes of a course you have already paid for without offering a reasonable alternative or, where appropriate, a remedy under our Refund Policy. The Platform is provided for personal, educational, non-commercial use only.

3. Enrolment and Course Access

Enrolment is confirmed once your payment has been successfully received and we have sent you a confirmation. Access to course content begins on the date stated for the course or, for self-paced courses, upon confirmation of enrolment, and continues for the access period specified on the course page.

Where a course includes live sessions, you are responsible for attending at the scheduled times and for meeting any prerequisites or technical requirements (such as a compatible device and stable internet connection) stated for the course. Recordings or make-up arrangements for missed live sessions are provided at our discretion and only where indicated for the relevant course. We may reschedule sessions or substitute instructors of comparable expertise where reasonably necessary.

4. Fees, Payments, and Taxes

Course fees are stated on the relevant course page or registration portal. All fees are payable in Indian Rupees unless stated otherwise. Prices may change from time to time, but the price applicable to your enrolment is the price displayed at the time you complete your purchase.

Payments are processed through third-party payment gateways. By making a payment you authorise the charge and agree to the payment provider's terms in addition to these Terms. We do not store full card or banking details on our systems. If a payment fails, is reversed, or is charged back without valid grounds, we may suspend or withdraw access to the relevant course until the matter is resolved.

5. Refunds and Cancellations

Refunds, cancellations, and rescheduling are governed by our Refund & Cancellation Policy, which forms part of these Terms and is available on the Platform. Except as required by applicable law or as expressly set out in that policy, fees once paid are non-transferable to another person.

We may cancel a course before it begins (for example, due to insufficient enrolment or circumstances beyond our control). If we do so and you have paid, you will be entitled to a full refund of the fee paid for that course, or, at your option, transfer to an alternative course of equivalent value where available.

6. Intellectual Property

All content made available through the Platform, including course videos, presentations, text, projects, assessments, code samples, graphics, logos, trademarks, the NextGen name, and the design and arrangement of the Platform, is owned by or licensed to NextGen and is protected by Indian and international intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

Upon enrolment, and for so long as your access remains valid, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the course content solely for your own personal learning. You may not copy, record, download (except where a download feature is expressly provided), reproduce, distribute, publicly display, resell, sublicense, or create derivative works from any content, nor remove any proprietary notices, without our prior written permission.

7. Learner Work and Submissions

You retain ownership of original projects, assignments, and other materials that you create and submit through the Platform ("Learner Submissions"). By submitting them, you grant NextGen a non-exclusive, royalty-free, worldwide licence to host, store, display, and use Learner Submissions to the extent necessary to provide the services, assess your work, and operate the Platform.

We may also wish to feature anonymised or attributed learner work for educational, promotional, or showcase purposes. We will only do so with the prior consent of you or, where you are a minor, your parent or legal guardian. You are responsible for ensuring that your Learner Submissions do not infringe the rights of any third party or contain unlawful content.

8. Acceptable Use

You agree to use the Platform lawfully, respectfully, and in keeping with its educational purpose. You must not: (a) access content you have not paid for, or circumvent any access controls, paywalls, or technical protection measures; (b) share login credentials or course materials with others; (c) record, screen-capture, or redistribute live sessions or course content; (d) upload or transmit any content that is unlawful, harmful, harassing, defamatory, obscene, or that infringes others' rights; (e) introduce malware, attempt to gain unauthorised access to our systems, or disrupt the Platform; or (f) use automated tools (such as scrapers or bots) to extract content or data.

We expect respectful conduct in all interactions, including live sessions, forums, and communications with instructors, mentors, and other learners. We may remove content, restrict features, or suspend or terminate access for conduct that breaches these standards.

9. Third-Party Services and Links

The Platform may rely on or link to third-party tools, services, and websites (for example, video hosting, payment gateways, collaboration tools, or AI services used within a course). Your use of such third-party services is subject to their own terms and privacy policies, and we are not responsible for their content, availability, or practices.

Where a course involves the use of generative AI or other third-party technology tools, you agree to use them in accordance with the applicable provider's terms and any guidance we provide. Any references to third-party products are for educational purposes and do not imply endorsement or partnership unless expressly stated.

10. Disclaimers

The Platform and its content are provided on an "as is" and "as available" basis. While we take reasonable care to provide high-quality educational content, we do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that any particular learning outcome, result, certification value, academic benefit, or career outcome will be achieved.

Course content is for general educational purposes and does not constitute professional, legal, financial, or career advice. To the maximum extent permitted by applicable law, we disclaim all warranties not expressly stated in these Terms, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NextGen, its directors, employees, instructors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunity, or goodwill, arising out of or in connection with your use of (or inability to use) the Platform, even if advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or relating to the Platform or a course, whether in contract, tort, or otherwise, shall not exceed the total amount of fees actually paid by you to NextGen for the specific course giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including liability for fraud, gross negligence, or death or personal injury caused by negligence.

12. Indemnity

You agree to indemnify and hold harmless NextGen, its directors, employees, instructors, and affiliates from and against any claims, liabilities, damages, losses, and reasonable expenses (including legal fees) arising out of or related to your breach of these Terms, your misuse of the Platform, your Learner Submissions, or your violation of any law or the rights of any third party. Where the learner is a minor, this obligation is undertaken by the parent or legal guardian who accepted these Terms.

13. Suspension and Termination

You may stop using the Platform at any time. We may suspend or terminate your account or access to a course, with or without notice, if you breach these Terms, fail to pay applicable fees, engage in fraudulent or unlawful conduct, or where we are required to do so by law.

Where we terminate access due to your material breach, you will not be entitled to a refund of fees already paid for the affected course. Termination does not affect any rights or obligations that accrued before termination, and the sections on intellectual property, disclaimers, limitation of liability, indemnity, and governing law survive termination.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Platform.

15. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them or your use of the Platform are governed by and construed in accordance with the laws of India. Subject to the following, the courts at Hyderabad, Telangana shall have exclusive jurisdiction.

In the event of a dispute, the parties shall first attempt to resolve the matter amicably through good-faith discussions. If the dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration by a sole arbitrator appointed in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad, and the proceedings shall be conducted in English.

16. Grievance Redressal and Contact

For any questions, complaints, or grievances regarding these Terms or the Platform, you may contact us at contact@nextgenlab.in.

We will acknowledge grievances within a reasonable time and aim to resolve them promptly. These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and NextGen regarding your use of the Platform. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
